Privacy Policy & SMS Privacy

Effective Date: October 1, 2026  |  Last Updated: July 14, 2026

1. Who We Are & Scope

This Privacy Policy describes how License 2 Close, LLC ("the Brokerage," "we," "us," or "our"), a Florida-licensed real estate brokerage located at 1211 Seminola Blvd, Unit 101, Casselberry, FL 32707, collects, uses, discloses, and protects personal information through this website and in connection with our brokerage, property management, and related services. This Policy applies to website visitors, leads, clients, customers, and other individuals who interact with us. It does not apply to information collected by third parties whose sites or tools we link to or embed.

2. Information We Collect

  • Information you provide: name, email address, phone number, property address, and details you submit through our forms (buying timeframe, selling plans, license status, and similar inquiry details).
  • Transaction and brokerage records: if you engage our services, we collect information reasonably necessary to perform brokerage services and comply with Florida law, which may include contract details, transaction correspondence, and records we are required to maintain under Chapter 475, Florida Statutes.
  • Communications records: emails, text messages, form submissions, chat messages, and records of calls with our team (see Section 8 regarding call recording).
  • Information collected automatically: IP address, device and browser type, pages visited, and interactions with the Site, collected through cookies and similar technologies.
  • Third-party tools: embedded search widgets and analytics or advertising pixels [LIST YOUR ACTUAL PIXELS, E.G., META PIXEL, GOOGLE ANALYTICS] may collect usage data subject to their own privacy policies.

3. How We Use Your Information

  • To respond to your inquiries and provide requested services (home value reviews, consultations, property management information, agent opportunities).
  • To perform brokerage services and fulfill our legal and professional obligations as a licensed Florida real estate brokerage under Chapter 475, Florida Statutes, and Division 61J2, Florida Administrative Code.
  • To manage client relationships through our customer relationship management (CRM) platform.
  • To send emails and, only with your separate express consent, text messages (see Section 7).
  • To improve the Site, measure marketing performance, and maintain the security of our systems.
  • To establish, exercise, or defend legal claims, and to comply with audits, subpoenas, and lawful requests from regulators including the Florida Real Estate Commission (FREC) and the Department of Business and Professional Regulation (DBPR).

4. How We Share Information

We do not sell your personal information, and we do not share your personal information with third parties or affiliates for their own marketing purposes. We may disclose information:

  • To service providers that operate our website, CRM, email, and text messaging systems, solely to perform services on our behalf and under obligations of confidentiality.
  • To transaction participants and professionals when reasonably necessary to perform brokerage services you have requested — for example, cooperating brokers, lenders, title and closing agents, inspectors, attorneys, and insurers involved in your transaction.
  • To the Multiple Listing Service: if you list a property with us, listing information (including property details and photographs) is submitted to the MLS and may be redistributed through IDX and listing syndication as permitted by MLS rules. Listing data, once published, may persist in third-party systems we do not control.
  • To regulators and legal authorities when required by law, regulation, subpoena, court order, or a lawful audit or investigation, including by FREC or DBPR.
  • In a business transfer: if the Brokerage or substantially all of its assets are acquired, merged, or reorganized, customer information may be transferred as part of that transaction, subject to this Policy.

5. Email Communications

If you submit a form, we may email you about your inquiry and related services. Marketing emails include an unsubscribe mechanism consistent with the federal CAN-SPAM Act. Unsubscribing from marketing email does not prevent transactional or service messages directly related to an active inquiry, transaction, or legal obligation.

6. SMS Privacy — No Third-Party Marketing Use

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be sold or shared with any third party for their own marketing.

Mobile information may be shared with service providers only as necessary to deliver the text messages you have consented to receive.

7. Text Messaging Consent — Florida Telephone Solicitation Act & TCPA

We send marketing or promotional text messages only with your prior express written consent, consistent with the Florida Telephone Solicitation Act, §501.059, Florida Statutes ("FTSA"), and the federal Telephone Consumer Protection Act, 47 U.S.C. §227 ("TCPA"). Consent is obtained through a clear act such as checking an unchecked consent box on our forms, and applies to the telephone number you provide. Consent is not a condition of purchasing any property, good, or service from us.

  • Opting out: Reply STOP to any message. We will send one final message confirming receipt of your request, and we will cease marketing text messages to your number within the period required by law (and in all cases within 15 days as provided by §501.059(10)(c), Florida Statutes).
  • Help: Reply HELP, call (407) 807-8007, or email [email protected].
  • Two-way number: Our text messages are sent from a telephone number capable of receiving calls and reply messages during normal business hours.
  • Fees and frequency: Message frequency varies; message and data rates may apply according to your carrier plan.
  • Transactional and informational messages directly related to your inquiry or transaction may be sent as permitted by law. See our SMS Terms for full program terms.

8. Call Recording & Monitoring Notice

Some calls with our team are recorded for quality assurance, training, or record-keeping. We provide a recording notice at the start of those calls. Call recording is subject to applicable consent requirements, including §934.03, Florida Statutes. If you do not consent to recording, you may end the call and communicate with us by email at [email protected] instead.

9. Data Security & Breach Notification — Florida Information Protection Act

We take reasonable measures to protect personal information in electronic form, consistent with the Florida Information Protection Act, §501.171, Florida Statutes ("FIPA"), including administrative, technical, and physical safeguards appropriate to the nature of the information. When customer records containing personal information are no longer required to be retained, they are disposed of securely. In the event of a data breach affecting personal information as defined by FIPA, we will provide notifications to affected individuals and authorities as and when required by that statute. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Records Retention — Florida Brokerage Requirements

As a licensed Florida real estate brokerage, we are required by §475.5015, Florida Statutes, to preserve books, accounts, and records pertaining to our brokerage business for at least five years, and longer where records are the subject of litigation or a regulatory proceeding. For this reason, we may be legally unable to delete certain information upon request, including transaction records, communications related to brokerage services, and records subject to escrow, audit, or legal hold requirements. We retain other personal information only as long as reasonably necessary for the purposes described in this Policy.

11. Your Privacy Choices & Rights

You may request access to, correction of, or deletion of your personal information by contacting us at [email protected]. We will honor verified requests to the extent permitted by applicable law and subject to the retention obligations described in Section 10. Note that the Florida Digital Bill of Rights (§§501.701–501.722, Florida Statutes) imposes its consumer-rights obligations on large "controllers" meeting revenue and business-model thresholds that do not currently apply to the Brokerage; we nevertheless voluntarily accommodate reasonable privacy requests as described here. If you are a resident of another state with an applicable privacy law, we will respond to your request in accordance with the law that applies to you, if any.

12. Cookies & Tracking

We use cookies and similar technologies for site functionality, analytics, and advertising measurement. You can control cookies through your browser settings. [IF YOU RUN RETARGETING ADS, DISCLOSE THAT HERE AND LINK TO OPT-OUT TOOLS SUCH AS THE NAI/DAA PAGES.]

13. Listing Data, IDX & Third-Party Tools

Property information displayed on or linked from this Site — including MLS/IDX data, new-construction search widgets, and mobile search applications — is provided by third parties, is believed to be reliable but is not guaranteed, and is subject to the rules and privacy practices of those providers. Any home value estimate or calculator output on this Site is an opinion or illustration only, not an appraisal (see §475.612, Florida Statutes, regarding appraisals), and creates no brokerage relationship or obligation. Third-party sites and tools are governed by their own privacy policies, which we encourage you to review.

14. No Brokerage Relationship Created

Submitting information through this Site, receiving communications from us, or using tools on this Site does not create a brokerage, agency, or fiduciary relationship. Brokerage relationships are formed only as provided under Chapter 475, Florida Statutes, and, where applicable, through written agreements and the brokerage relationship disclosures required by Florida law.

15. Children's Privacy

This Site is not directed to children under 18, and we do not knowingly collect personal information from children. If you believe a child has provided us personal information, contact us and we will delete it.

16. No Contractual Rights Created

This Policy is a statement of our current practices. It is not a contract and does not create any legal rights for any person or any obligations on the Brokerage beyond those imposed by applicable law. We may update this Policy at any time; the "Last Updated" date above reflects the most recent revision, and continued use of the Site after an update constitutes acceptance of the revised Policy.
